What is Expungement?

While the public record is cleared, the court retains a nonpublic record of the conviction. Not all convictions qualify for expungement, so understanding Michigan’s specific eligibility rules is crucial.

Who is Eligible for Expungement?

Michigan’s expungement laws were updated on January 12, 2015, expanding eligibility. Previously, only individuals with one conviction and no more than two minor offenses could apply. Now, more people qualify, provided they have:

  • No more than one felony conviction
  • No more than two misdemeanor convictions

Certain convictions are ineligible for expungement, including:

  • Crimes carrying a maximum sentence of life in prison, regardless of the actual sentence
  • Traffic offenses in Michigan
  • Sex crimes, including attempted offenses

Additional notes:

  • If you served time in prison, you must wait five years from your release date to apply for expungement.
  • For juveniles, any offense can be expunged if they have three or fewer offenses and no felony convictions.

The Expungement Process

To begin the expungement process, you must submit an application to the court where your conviction occurred. Required documents include:

  • A fingerprint card (available from any law enforcement agency)
  • A copy of your conviction record
  • Personal information, including the name and address of the prosecutor in your case

A court hearing will follow, where you’ll present your case to a judge to demonstrate why your conviction should be expunged. Victims and law enforcement involved in your case may support or oppose your application. Providing evidence of a crime-free record since your conviction can strengthen your case.
