Law Enforcement Officers: If you have just been involved in a critical incident (i.e. serious crash, shooting, in-custody death, significant use of force, etc.), call us right away and call your union representative. Just because you are a police officer, doesn’t mean you give up your rights. You DO have the right to remain silent. If you involved in a critical incident make no mistake about it, YOU are the suspect and anything you say can and will be used against you. You have the right to an attorney prior to and during any questioning. This includes before writing your report. I highly encourage you to contact us before making any statement. If you cannot afford an attorney, one may be appointed. Your union may have an agreement with a legal defense fund that will cover your legal expenses. General Public Emergencies: If you have been arrested or are out with police and they are questioning you, say absolutely nothing other than “I will not speak without an attorney present,” then call us right away! Most of the convictions in this country would not happen if people didn’t walk themselves into saying something that will be construed as an admission. Just don’t say anything! Do no consent to any search without speaking with one of our attorneys first.
